| Since this tenant is on a month to month, you are only required to give him 30 days or however many days your state statutes stipulates to vacate. You can read state statutes and local law by clicking on the legal resources link above and click your state. He must vacate within 30 days. If not, you can start eviction proceedings. You do not mention if the request was verbal or in writing. Make sure correspondence is in writing and send it by certified mail, return receipt requested, with a hard copy mailed to the property. If he does not pay his rent, you can send him a 3 or 5 day notice (depending on your state) to pay or quit. If not, then you can file eviction proceedings immediately.

My father has a duplex and one of the tenants was asked to vacate property because my father will be renting the unit to my brother. The tenant now called the health department claiming repairs do not want to be done. My father has tried to come in contact with the tenants but they refuse to speak to him or even open the door.
My father did reimburse them last month when they claimed to have roaches and had to fumigate.
The tenants in the other unit do not have complaints and have been there for years vs. these new tenants which have only been there for 8 months.
Can anyone tell me what my father should do? The request to vacate premises was given exactly 30 days ago.
There is no contract it was a verbal agreement of monthly tenancy.
I would like to assist my father but I am clueless in this-
any help/advise?
