| That's great news for you. (Sorry I misread the post.) Since they were never presented with the lease, you can simply state that they don't meet your criteria (non-smokers).

| You can deny to smokers. However, since you already signed the lease, you are obligated to rent to them. (You should have asked this question at showing and on your application. You might have been able to them terminate for lying on the application.) You should have written the lease to say no smoking. If so, and they smoke in the unit, you can charge them for any smoke related damages. I don't belive you can charge additional deposit for pets or smoking in NJ. You are limited to 1 & 1/2 months rent.

i showed an apartment to a small family of three and not until after the application was signed and a deposit was given, one of the applicants lit up a cigarette. i prefer not to rent to smokers because of the liability. in new jersey, can i legally deny applicants because of this?
