You have the most amount of "influence" over the Seller before the sale closes.  Make it a condition of your purchase that the Tenant is out and that the trash is out before the close of escrow.  Until escrow closes, the noted problems are the responsibility of the owner.  After escrow closes, the problems and related expenses will be all yours.

Be sure you read through the Landlord Tenant Laws for the State/County/City where the rental property is located to find out who is responsible for the current Tenant's Security Deposit.  If the Tenant is still in the property when the sale closes, you could "inherit" a debt...

Purchasing a property to rent out the person I am buying it from is out of state.  It has possibility of 5 units but currently only one rented. They have been told they must vacate the premises, there is no lease.  The problem, beside getting them out, is that they have stacked probably 40 or more very large trash bags in the downstairs apt. Is there any way to make them pay for the removal of all of that?
