It was not just my unit that was illegal but also the 3rd floor person had to move out and there rent  was $650.00 and they went up to $850.00 and they got the $400.00 without having to repay. I got a lawer and now I don't have to pay it back also. It was the clerk, she was doing what she wanted and not the law. I also got 6x my rent because in NJ the landlord broke the lease and the law. NJ is very hard on landlords that rent out illegal aptments because they pay no texes and the health codes.

If I am understanding your situation correctly, the additional $200. is a higher security deposit for the unit you are currently renting.  If so, this would not be a "moving expense".  The security deposit is money that is deposited with the Landlord to secure your Lease and would be something that you are able to get back in the future.  It is an asset, not an expense, and it would be a profit to you if the initial Landlord would be required to pay your increased security deposit amount.  From what you posted, the initial Landlord was required to refund all of the money you paid to him/her already.


If you are confused about what "moving expenses" specifically means, clarify that in writing with the relocation department.  If the you and the clerk are not "on the same page", try politely asking for a supervisor to help clarify what exact moving expenses the initial Landlord is required to pay. For example, does "moving expenses" include a moving truck, for example, or just a total refund of all monies paid to the previous Landlord.

I am a tenant in Elizabeth, NJ. I rented an apartment on June 1st 2008 at $525.00 with a deposit of $525.00. On June 4th the city of Elizabeth inspected the apartment and told me I had 5 days to relocate because the apartment was illegal. The Housing Inspector gave the landlord an order that he was responcible for all moving expenses. I found an apartment with the rent of $500.00 and the security deposit of $750 (a month and a half). The city of Elizabeth Relocation dept. told me that the landlord was only responcible for a total of $1050.00 and the balance of $200.00 was my responcibility. I was told this because I only lived here less than 3 months.

Am I responcible for the $200.00 difference in the deposit?

My problem is with the clerk at the relocation dept. telling me either I pay the $200.00 difference or I don't get any assistance and I become homeless. I am on SSI. She made me sign a letter stating  to repay the city for the landlord gave them money orders for my relocation expenses. I was told I was not to be able to profit from the new deposit difference. Please Help!!!
