I agree with OH landlord's post.   You may be OK as long as your Landlord agrees that you are to receive your full security deposit back.  If not, you will have difficulties proving in court (convincing a Judge) that you had a verbal agreement with your Landlord that changed the terms of your written Lease.  What proof do you have that the Lease ended on May 1st?  Do you have anything to support your agreement?

In the future, always get written verification, signed by all parties, when changes or addendums are made to a Lease Agreement.  How can you prove that the Landlord agreed to an early Termination of your Lease?  Did he/she acutally agree to the early termination or did he/she just say "OK" when you told him/her that you were moving out of the property prior to the Lease expiration date?

When you send your Landlord a request for refund of the deposit, be sure you keep a copy of the letter.  The certificate of mailing and Landlord's signature of receipt will demonstrate that he/she received your letter.  Even if the Landlord does not sign for the certified letter you should receive a return of the receipt with the post office's note that the Landlord refused to sign for the letter.

Stop calling him or e-mailing.  You can't get anywhere that way.  Send a certified letter to your LL to demand the deposit back.  (He may not really be in Europe.)  The only problem I see is that you didn't get a letter to release you from the obligations of your lease for the early termination.  I hope he remembers your conversation and agreement.  If not, it will be your word against his that he agreed to allow you to terminate early.

My landlord and I had a verbal agreement that I would end my lease early, it's been almost 3 months and he hadn't given my secuirty deposit back, responded to my 30 phone calls or email!

Between my Finance' and I calling and leaving messages my landlord FINALLY texted me back the 2 of July (lease ended MAY 1st) and said that he has gotten my messages but is in  EUROPE and there is bad phone reception there! He also said that he will get my security to me when he comes back on July 28th? There has got to be some legal issues here! I have no idea where to start! I researched and found that he has 30 days to give my deposit with interest back, but I don't know where to go from there......and how to get my full refund at this point! Can ANYONE PLEASE help me? I am not from NJ and I really don't know where to go?
